Article 29 Working Party (WP) on data protection was created on the grounds of Article 29 of Directive 95/46/EC of the European Parliament and of the Council of 24 October 2005 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
Article 29 Working Party is an independent European body, with consultative character, which is composed of representatives of the national data protection authorities (DPAs) of the EU member states, representatives of Community institutions and bodies and also the representatives of the European Commission.
The president and the vice-president of the WP are elected by secret voting, by majority of votes.
The WP:
- At the European Commission’s request, issues opinions regarding the level of data protection in the Member States and in third countries;
- Issues consultative opinions on drafts legislative acts amending the Directive, on any additional or specific measures adopted in order to safeguard the rights and freedoms of natural persons with regard to the processing of personal data, as well as on any other proposed Community measures affecting such rights and freedoms;
- Issues opinions on codes of conducted issued at Community level;
- Issues recommendations, as well as other documents on all matters relating to the protection of persons with regard to the processing of personal data within the Community, with a view of a unitary enforcement of the national normative acts transposing the relevant community dispositions.
The documents adopted by Article 29 Working Party are published, except for the cases in which the WP decides the otherwise.
The representatives of the national supervisory authorities of the candidate states are invited to participate at the reunions of the WP as observes, without the right to vote.
Romania participates at the periodic reunions of the WP with 1-2 representatives of the National Supervisory Authority for Personal Data Processing.
